1. About these terms

These terms apply when you use stillab.co.nz or order from STIL LAB. "We", "us" and "our" mean STIL LAB, Building C319, Ballance Road, Waiouru 4826, New Zealand (NZBN 9429032609202). "You" means the person using the site or placing the order.

You accept these terms when you place an order. Please read them, along with our Refund Policy, Shipping Policy and Privacy Policy, which form part of these terms.

2. Your rights under New Zealand law

If you buy as a consumer, you have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 that can't be excluded. Nothing in these terms limits those rights. If any part of these terms appears to, the law wins.

3. Who can order

You must be 18 or older, or have the permission of a parent or guardian, to place an order.

4. Prices and payment

Prices are in New Zealand dollars and include GST. Shipping is calculated at checkout and shown before you pay. We take payment when you place your order.

If a price on the site is clearly wrong (for example, a typing error), we will contact you before making your order. You can then pay the correct price or cancel for a full refund.

5. Made to order

Every print and frame is made specifically for you from the image and options you choose. Please check your size, crop, paper and frame before you order. Our designer shows how your print will look, but screens vary, so colours and brightness on the finished print may differ slightly from what you see on your screen.

Because each order is made to order, we can't accept change-of-mind returns. This does not affect your rights if something is faulty or not what you ordered. See our Refund Policy.

6. Your images and copyright

When you upload an image or place an order, you confirm that you own the copyright in that image, or that the copyright owner has given you permission to have it printed and framed. This includes any people, artwork, logos or other material that appear in it.

You are responsible for the images you send us. We print what you upload and do not check who owns it, so STIL LAB is not responsible for any breach of copyright or other rights in the images you provide. If anyone makes a claim against STIL LAB because of an image you sent us, you agree to cover our reasonable costs, including legal costs, arising from that claim.

You keep the copyright in your images. You allow us to copy, store and process them only as needed to make, deliver and support your order.

7. Images we won't print

We may refuse or cancel an order if:

• we have reason to believe an image infringes someone else's rights (for example, a professional photograph with a watermark, or a studio's proofs);
• the image is objectionable, offensive or unlawful; or
• the file can't produce a good print at the size you chose. In that case we will usually contact you first to suggest a smaller size or a better file.

If we cancel your order for any of these reasons before printing, we will refund you in full.

8. Storing your files

We keep a copy of the files for your order so we can reprint or replace it if anything goes wrong. Please keep your own copies too. We can't guarantee we will keep files indefinitely.

9. Delivery

We deliver by courier to the address you give at checkout. Delivery times are estimates. Once your order is with the courier, we will help you track it, and if it arrives damaged, please contact us as set out in our Refund Policy.

10. Our liability

Your rights under the Consumer Guarantees Act 1993 come first (see section 2).

Apart from those rights, and to the extent the law allows:

• our total liability for any order is limited to the price you paid for that order; and
• we are not liable for indirect losses, such as lost profits or lost business opportunities.

Nothing in these terms limits our liability for anything that can't be limited by law.

11. Using the site

Please don't use the site for anything unlawful, upload viruses or harmful code, try to get around its security, or copy or scrape its content. We may stop anyone from using the site who does.

12. Your personal information

We handle your personal information under the Privacy Act 2020, as set out in our Privacy Policy.

13. Changes to these terms

We may update these terms from time to time. The terms that apply to your order are the ones on this page when you placed it.

14. Problems and disputes

If something isn't right, please contact us first at info@stillab.co.nz or 027 539 7510, and we'll do our best to sort it out. If we can't agree, you can take the matter to the Disputes Tribunal or another New Zealand court or tribunal.

These terms are governed by New Zealand law.
